{"id":98920,"date":"2026-06-03T06:55:59","date_gmt":"2026-06-03T06:55:59","guid":{"rendered":"https:\/\/www.timberindustrynews.com\/?p=98920"},"modified":"2026-06-04T08:39:10","modified_gmt":"2026-06-04T08:39:10","slug":"brazil-faces-potential-25-u-s-tariffs-under-section-301-ruling","status":"publish","type":"post","link":"https:\/\/www.timberindustrynews.com\/ro\/brazil-faces-potential-25-u-s-tariffs-under-section-301-ruling\/","title":{"rendered":"Brazil faces potential 25% U.S. tariffs under Section 301 ruling"},"content":{"rendered":"<p class=\"isSelectedEnd\">The Office of the U.S. Trade Representative (USTR) has proposed an additional 25% tariff on imports from Brazil following a Section 301 investigation that concluded several Brazilian policies and practices are unreasonable or discriminatory and burden U.S. commerce.<\/p>\n<p class=\"isSelectedEnd\">The investigation examined six areas that USTR believes affect the competitive position of U.S. companies.<\/p>\n<p class=\"isSelectedEnd\">The first concerns digital trade and electronic payment services. USTR criticized measures affecting U.S. technology companies and raised concerns about Brazil's treatment of digital platforms and the rapid expansion of the Pix electronic payment system, which the agency believes may disadvantage foreign providers.<\/p>\n<p class=\"isSelectedEnd\">A second area relates to preferential tariff treatment granted by Brazil to certain countries, particularly Mexico and India. According to USTR, these arrangements provide advantages that are not available to U.S. exporters.<\/p>\n<p class=\"isSelectedEnd\">The agency also reviewed Brazil's anti-corruption enforcement framework, arguing that weaknesses in implementation may create an uneven business environment for foreign companies operating in the country.<\/p>\n<p class=\"isSelectedEnd\">Intellectual property protection was another focus of the investigation. USTR concluded that deficiencies in the protection and enforcement of intellectual property rights continue to create concerns for U.S. businesses.<\/p>\n<p class=\"isSelectedEnd\">The investigation further examined market access conditions for U.S. ethanol exports. Washington argues that Brazilian policies restrict opportunities for American ethanol producers and limit access to the Brazilian market.<\/p>\n<p class=\"isSelectedEnd\">For the forest sector, the most significant element of the investigation concerns illegal deforestation and illegal logging. USTR stated that insufficient enforcement of environmental laws may allow products originating from illegally cleared land or illegally harvested timber to enter domestic and international supply chains. The agency specifically referred to the potential impact on agricultural products, lumber and wooden furniture.<\/p>\n<p class=\"isSelectedEnd\">Based on these findings, USTR determined that the practices identified are actionable under Section 301 of the Trade Act of 1974 and proposed an additional 25% tariff on Brazilian-origin imports.<\/p>\n<p class=\"isSelectedEnd\">The proposal is not yet final. USTR has opened a public consultation period, with comments due by July 1, 2026, followed by a public hearing scheduled for July 6.<\/p>\n<p class=\"isSelectedEnd\">The agency has also proposed a number of product exclusions. These include certain raw materials, informational materials, products already covered by Section 232 measures and other goods listed in the annex accompanying the proposal.<\/p>\n<p>For Brazil's forest industry, the proposal does not immediately impose new restrictions on timber exports.
