A German court has rejected a forest owner\u2019s attempt to force authorities to intervene against a nearby sawmill accused of increasing bark beetle pressure by storing unbarked logs from infested areas.<\/p>\n
The case shows growing tensions in parts of Central Europe where bark beetle outbreaks continue to threaten softwood forests already weakened by drought and rising temperatures.<\/p>\n
The plaintiff, a forest owner whose stands are located between 50 and 500 metres from the sawmill\u2019s timber yard and bark storage area, argued that beetles emerging from stored logs were spreading into surrounding forests and causing severe damage.<\/p>\n
According to court documents, the sawmill stores between 20,000 and 25,000 cubic metres of roundwood on site. The plaintiff claimed that roughly 10,000 to 15,000 cubic metres consisted of unbarked logs, while even \u201cdebarked\u201d timber still retained portions of bark capable of hosting insects.<\/p>\n
The forest owner said pest pressure increased sharply after the sawmill began operations.<\/p>\n
Before the facility opened, annual salvage harvesting from beetle damage averaged around 20 cubic metres, according to the filing. In 2021, the volume of damaged timber removed from the plaintiff\u2019s forest rose to around 150 cubic metres. A similar level was reported again in 2022.<\/p>\n
The plaintiff argued that continued storage of infested logs and bark near vulnerable spruce stands could eventually destroy large parts of the surrounding forest within five to ten years.<\/p>\n
The lawsuit sought intervention from local building authorities, demanding either a ban on storing bark-covered logs at the site or mandatory measures preventing bark beetles and other pests from spreading into neighbouring forests.<\/p>\n
The case centered on whether building authorities could act against the sawmill under public construction law.<\/p>\n
The Administrative Court rejected the claim, ruling that building law does not provide neighbouring forest owners with legal protection against bark beetles emerging from timber yards.<\/p>\n
The court said possible intervention powers against beetle infestations fall primarily under forestry law rather than building regulations.<\/p>\n
According to the ruling, building authorities are responsible for enforcing construction-related legal requirements, but not for broader forest protection measures connected to pest outbreaks.<\/p>\n
The judgment also noted that forestry authorities, rather than local building offices, hold primary responsibility for bark beetle monitoring and control.<\/p>\n
The plaintiff had argued that storage sites handling potentially infested logs should be located at least 500 metres from vulnerable conifer stands, citing forestry subsidy program conditions used for temporary damaged timber storage.<\/p>\n
However, the court said no legal basis existed requiring building authorities to impose such restrictions on the sawmill.<\/p>\n
It also stated that storing timber near forest land could not be considered an exceptional situation in rural areas.<\/p>\n
The court therefore declined to examine whether beetles from the sawmill were directly responsible for damage in the plaintiff\u2019s forest, arguing that the central legal issue concerned administrative jurisdiction rather than biological causation.<\/p>\n
Bark beetles remain one of the most serious threats to spruce forests across Germany, Austria and the Czech Republic following years of drought and storm damage that weakened large areas of conifer stands.<\/p>\n
