Two U.S. importers have withdrawn their challenges to the Commerce Department\u2019s anti-circumvention determination involving hardwood plywood from Vietnam. Rugby Holdings LLC<\/strong> and Hardwoods Specialty Products<\/strong> had filed suit over the agency\u2019s decision to extend antidumping and countervailing duties on Chinese hardwood plywood to certain Vietnamese shipments.<\/p>\n

At the heart of the dispute was Commerce\u2019s certification requirement, which obliges exporters and importers to maintain records proving Vietnamese rather than Chinese origin in order to avoid duties. The companies argued that, in practice, the liquidation instructions issued by Customs forced mandatory submission of certifications with every entry, even though the written rule only required retention of documents for possible review.<\/p>\n

Both Rugby and Hardwoods had sourced their plywood from Greatwood Hung Yen<\/em>, one of the exporters eligible for the certification process. They claimed the enforcement approach effectively undermined the intent of the certification regime.<\/p>\n

With the withdrawal of the cases, Commerce\u2019s circumvention finding and the certification framework remain in place.
