<\/span>The U.S. wood industry, represented by the Coalition for Fair Trade in Hardwood Plywood, has asked the U.S. Court of International Trade to maintain high duties on Chinese plywood imports. The coalition argued that Chinese importers did not adequately cooperate with the Department of Commerce\u2019s anti-dumping investigation, which examined alleged unfair pricing practices in hardwood plywood exports from China. The coalition contends that the Commerce Department's levying of antidumping and countervailing duties was warranted after Chinese plywood companies failed to meet reporting requirements.<\/p>\n

In 2020, Commerce issued questionnaires to several Chinese plywood producers, seeking information on product origins, affiliations with exporters, and business practices. The coalition stated that dozens of Chinese companies either failed to respond or provided incomplete, inaccurate, or misleading information, despite multiple opportunities to clarify their responses. In its court filing, the coalition asserted that Commerce met all procedural obligations by notifying these companies of reporting deficiencies and offering multiple chances to amend their responses.<\/p>\n

The coalition emphasized that, under trade law, Commerce is allowed to use \"adverse facts\" in determining duties if companies fail to cooperate. According to the coalition\u2019s attorney, Timothy Brightbill, the investigation revealed widespread non-compliance, with 14 companies not responding at all and 22 others providing substantially deficient information. This, the coalition argued, warranted the application of higher duties as a penalty for obstructing the investigation.<\/p>\n

One importer, Shelter Forest International, is challenging Commerce\u2019s decision, arguing that its products sourced from Leachenwood Viet Nam Co. Ltd. in Vietnam should not face duties intended for Chinese imports. Shelter Forest claims that Commerce ignored relevant data and failed to assess their claim fairly. Nonetheless, the coalition maintains that Commerce acted within its rights to penalize companies for incomplete disclosures, stating that accurate and transparent responses were required to assess fair trading practices accurately.<\/p>","protected":false},"excerpt":{"rendered":"
