The plaintiff accused the state of Baden-Württemberg of having operated a log wood cartel for decades, forcing sawmills to pay inflated prices.

For years, the Baden-Württemberg forestry administration has largely managed the sale of roundwood centrally - and in doing so has violated antitrust law. This was the decision of the Higher Regional Court in Stuttgart on Thursday.

The Federal Cartel Office banned the sale of wood in 2015

The legal dispute concerns the quantities of roundwood that the state sold between 1978 and 2015. The Baden-Württemberg forestry administration centrally marketed around two thirds of the roundwood - such as tree trunks - from the state's forest areas. Around a quarter of these forests belonged to the state, the rest was distributed among municipalities and private individuals.

The same price was charged for the wood regardless of its origin. This led to a noticeable distortion of competition. In 2015, the Federal Cartel Office classified the sales practice as a violation of competition law and banned it. Since then, there has been a legal dispute over the issue - the state has now reformed the controversial forestry administration.

BW Agriculture Minister Hauk remains calm

Baden-Württemberg's Minister of Agriculture Peter Hauk (CDU) was calm when speaking to SWR: "It was to be expected that the verdict would be similar. We acted on the basis of the constitutional order at the time - it was clearly laid down what the state was doing," said Hauk. The case could still go as far as the Federal Court of Justice to determine whether this was a timber cartel or not. The amount of damages will only be calculated once the verdict is final.

A court in Germany has found that antitrust laws were breached over a 27-year period in the management of timber contracts, potentially leading to damages of up to €500 million.
