This regulation mandates a crucial requirement for all importers of timber and timber-based products within the EU: the implementation of a due diligence system before importing.<\/p>\n<p>Under the EUDR, importers are tasked with the responsibility of gathering information and documentation to substantiate the legal origin and deforestation-free status of their wood and wood products. This verification process necessitates confirming that the timber derives from areas where no deforestation or forest degradation, as stipulated by the Regulation, has occurred since December 31, 2020.<\/p>\n<p>The EUDR casts a wide net, encompassing various timber products, including sawn timber, wood-based materials, paper, and furniture. Hence, as an exporter, it is imperative that you equip your EU importers (i.e., your customers) with specific information and documentation necessary for compliance with the EUDR.<\/p>\n<p>The information and documentation that you, as an exporter, must provide to EU importers to facilitate their adherence to EUDR requirements are as follows:<\/p>\n<ol>\n<li><strong>Tree species (scientific name):<\/strong> Scientific names for all tree species contained in the product are mandatory. Merely indicating the genus (e.g., Pinus spp. or Eucalyptus spp.) is insufficient; both genus and species must be specified (e.g., Pinus radiata or Eucalyptus globulus). It's important to note that European authorities have the capacity to verify this information using laboratory tests, including microscopic and genetic analyses.<\/li>\n<li><strong>Country of harvest:<\/strong> The precise country or countries where the wood was harvested must be indicated. If there are variations in deforestation or legality risks within a particular country, it is necessary to specify the region. European authorities can verify this information through laboratory tests, including genetic and isotope analysis.<\/li>\n<li><strong>Geo-coordinates of all plots of land:<\/strong> To ensure complete traceability, exact geo-coordinates for all land plots where the wood within the product may have been harvested are obligatory. For plots measuring 4 hectares or less, a single point suffices, while larger plots require a sufficient number of points to accurately delineate the perimeter. These coordinates, consisting of latitude and longitude values with a minimum of six decimal places, must be entered by importers for each individual import through an EU online portal. This system is designed to detect any unrealistic or inconsistent information, such as suppliers submitting identical coordinates to multiple importers, even when sourcing wood from different areas.<\/li>\n<li><strong>Date or time range of harvest:<\/strong> Importers must be provided with information regarding the date or time range of timber harvesting. European authorities have the capability to employ satellite imagery to verify whether the harvest occurred within the specified timeframe.<\/li>\n<li><strong>Evidence of legal harvest:<\/strong> Compliance with the EUDR necessitates demonstrating that the timber conforms to the relevant legislation in the country of production. This encompasses various aspects, including land use rights, environmental protection, forest-related rules (pertaining to forest management and biodiversity conservation), third-party rights, labor rights, human rights under international law, the principle of free, prior, and informed consent (FPIC) as outlined in the UN Declaration on the Rights of Indigenous Peoples, and tax, anti-corruption, trade, and customs regulations. The specific evidence required will depend on the applicable legislation in the country of harvest and local legality risks. Depending on the circumstances, some aspects may not be relevant. In cases where indigenous communities are present in or around the logging area, it is crucial to demonstrate that their rights have not been violated. If the country of harvest mandates logging permits, these permits must be provided, along with official transport documentation. In situations where logging on private land does not require permits, alternative evidence of legality must be furnished. Additionally, internationally recognized certification schemes can serve as valuable tools for demonstrating legality. To establish the connection between the provided geo-coordinates, evidence of legality, and the exported timber product, proof of the supply chain, in the form of delivery notes or invoices, is mandatory. It is crucial to ensure that the documentation aligns with the exported timber and is plausible in terms of dates and quantities. Enhanced risk mitigation measures are expected for timber originating from countries with high levels of illegal logging or corruption.<\/li>\n<li><strong>Evidence of deforestation-free status:<\/strong> Importers are obliged to substantiate that the imported products have not contributed to deforestation or forest degradation. While satellite imagery can be employed for this purpose, any other credible evidence attesting to the product's deforestation-free status should also be provided to the importer.<\/li>\n<\/ol>\n<p>Failure to provide the required information and evidence may result in the goods being withheld for import into the EU by Customs authorities. This could lead to potential storage charges at EU borders until the necessary information is furnished or the goods may even be subject to return. Importers and their customers could also face legal repercussions.<\/p>\n<p>It is crucial to acknowledge that the EUDR applies to all wood and wood products harvested from June 29, 2023, and placed on the EU market from December 30, 2024, onward. Therefore, it is of paramount importance that you initiate the process of gathering the requisite information promptly. Failure to comply with these stipulations will render you unable to export wood products to the EU after December 30, 2024.<\/p>\n<p>It is worth noting that a specific scenario applies to wood products harvested from June 29, 2023, and delivered to the EU prior to December 30, 2024. For these products, importers must adhere to the EUTR and ascertain that the wood was legally harvested. Nevertheless, if these products, or wood products derived from them, are traded within or exported from the EU after December 30, 2024, importers and their customers will be obligated to provide the information and documentation detailed above.<\/p>\n<p>In closing, the ETTF underscores the vital role played by exporters in informing their timber suppliers about this new regulation and facilitating the transmission of this crucial information. This collaborative effort is deemed the sole means by which suppliers can ensure the provision of necessary information in a timely manner.
