Despite their efforts to seek government intervention and impose duties on Chinese exporters, Canadian industry players have been unsuccessful in their attempts.<span id=\"more-32924\"><\/span><\/p>\n<p><strong>Unfair competition from Chinese imports<\/strong><\/p>\n<p>The president of the Canadian Hardwood Plywood and Veneer Association, Mr. Zarate, highlights the declining market share of Canadian producers in comparison to Chinese plywood imports. Chinese products, benefiting from heavy government subsidies and access to illegally harvested wood, flood the global market with cheap alternatives that undercut Canadian manufacturers on pricing. As a result, Canadian producers struggle to match, let alone beat, the prices offered by their Chinese counterparts.<\/p>\n<p><strong>Industry appeals for duties<\/strong><\/p>\n<p>In April 2020, Canadian industry players filed a complaint with the Canada Border Services Agency (CBSA) urging an investigation into dumping and subsidies by Chinese competitors. They argued that Canadian producers face consistent undercutting by dumped and subsidized Chinese imports, leading to lost sales, price reductions, and significant injury to the domestic industry. However, their plea did not yield the desired outcome, as the CBSA decided not to pursue an investigation into Chinese products.<\/p>\n<p><strong>Federal Court appeal rejected<\/strong><\/p>\n<p>Frustrated by the CBSA's decision, the Canadian Hardwood Plywood and Veneer Association appealed in the Federal Court. Unfortunately, the Federal Court of Appeal upheld the decision in April, further exacerbating the industry's struggles. The rejection of the appeal dealt another blow to Canadian producers, leaving them searching for alternatives in a disrupted market dominated by Chinese imports.<\/p>\n<p><strong>Growing Chinese presence and market distortions<\/strong><\/p>\n<p>Chinese exporters have significantly increased their presence in Canada over the past 15 years, now accounting for more than half of the country's market share. The influx of Chinese-made products has created an uneven playing field, as they are sold at significantly lower prices compared to Canadian-made goods. The price disparity puts immense pressure on Canadian firms, leading to the closure of numerous plywood and veneer mills throughout the country.<\/p>\n<p><strong>Conflicting perspectives<\/strong><\/p>\n<p>Trade lawyer Gordon LaFortune, representing Chinese companies under scrutiny by the CBSA, contends that there is no evidence to support the imposition of duties on Chinese products. LaFortune argues that the costs of Chinese producers are not distorted, debunking claims made by Canadian industry players. According to LaFortune, if there were valid grounds for imposing duties, the CBSA would have taken action accordingly.<\/p>\n<p><strong>Disappointing findings by CBSA and trade tribunal<\/strong><\/p>\n<p>The CBSA investigation found that while some Chinese firms were indeed dumping products and receiving subsidies, there was no evidence of a \"particular market situation\" in the decorative plywood space involving a substantial number of Chinese companies. Additionally, in February 2021, the Canadian International Trade Tribunal determined that dumping and subsidizing decorative plywood products had not caused injury or posed a threat to the domestic industry.<\/p>\n<p><strong>Lack of consistency with the United States<\/strong><\/p>\n<p>The United States, facing similar challenges, imposed anti-dumping and anti-subsidy duties on Chinese-made decorative plywood products in 2017. This disparity between the Canadian and American responses has left industry representatives and union members in Canada bewildered.
