November\u2019s midterm elections could give Democrats control of one or both chambers and more room to challenge parts of Donald Trump\u2019s tariff programme, while a separate case before the US Court of International Trade is testing the legal basis of the new Section 301 duties imposed on imports from dozens of trading partners. For exporters, the key point is that the current tariff structure is not equally secure across all product groups.<\/p>\n<p><strong>Canada tariffs could become a congressional target<\/strong><\/p>\n<p>The clearest political risk concerns the 50% tariffs imposed on a range of Canadian goods under Section 338 of the Tariff Act of 1930. Democratic lawmakers have already introduced legislation aimed at repealing that authority and refunding duties collected under it, although under the current balance of power the bill has limited prospects.<\/p>\n<p>A change in control after the midterms would alter that. A Democratic House could move repeal legislation and hearings without relying on Republican leadership, while control of the Senate would give the party more leverage over trade policy. That would not mean an automatic end to the tariffs, because the president could veto repeal legislation and overriding a veto would require a two-thirds majority in both chambers, but the political environment would become much less predictable.<\/p>\n<p>For Canadian panels, paper and other affected wood products, tariffs that now look settled could become the subject of repeated votes, hearings and negotiations in 2027, particularly if lawmakers from states closely tied to Canadian trade come under pressure from domestic industries and importers.<\/p>\n<p><strong>Section 301 faces a more immediate legal test<\/strong><\/p>\n<p>The court challenge could have more direct consequences. The US Court of International Trade is reviewing the administration\u2019s Section 301 tariffs imposed on imports from 60 economies over forced-labour-related trade practices, with duties generally ranging from 10% to 12.5% and affecting a wide range of goods, including some wood products such as hardwood plywood and furniture.<\/p>\n<p>The challengers argue that the administration pushed Section 301 beyond its intended use and failed to make sufficiently specific findings for each country. If the court agrees, the administration could be forced to narrow, rewrite or justify the measures again, while importers would be expected to pursue refunds on duties already paid. That would create another round of uncertainty for companies that have only recently adjusted sourcing, pricing and contracts around the new tariff structure.<\/p>\n<p><strong>Softwood lumber remains on firmer ground<\/strong><\/p>\n<p>Softwood lumber is in a different position because its 10% tariff sits under Section 232 on national security grounds and is not part of the current Section 301 court challenge. It is also separate from the congressional effort aimed at Section 338, which makes the softwood lumber tariff more durable for now.<\/p>\n<p>The result is an uneven trade environment in which Section 301 is exposed to the courts, Section 338 is exposed to Congress and the midterms, and Section 232 remains comparatively secure. For wood-product exporters, the question is therefore no longer simply how high US tariffs are, but which of them will still exist in the same form next year.
