The European Union has formally published the revised EUDR product list, closing several open questions for sawmills, pallet manufacturers, wood processors and the pulp and paper industry. Commercial sawmill residues remain covered, while waste, second-hand goods, recovered paper and packaging already in use receive clearer exemptions.<\/p>\n

The final revision of the products covered by the EU Deforestation Regulation was published in the Official Journal on 17 September, giving the wood industry a definitive Annex I less than four months before the regulation begins applying to most timber operators.<\/p>\n

Commission Delegated Regulation (EU) 2026\/2102, adopted on 13 July, changes the list of relevant commodities and products under Regulation (EU) 2023\/1115. For timber companies, the revision leaves the main structure of the EUDR largely intact but draws a sharper line around waste, second-hand products, reusable packaging and recovered raw material.<\/p>\n

The principal timber categories remain in scope. Roundwood, sawn wood, panels, wood pulp, paper, wooden packaging sold as a product, joinery, furniture and numerous other downstream wood products continue to fall under the regulation.<\/p>\n

What has changed is the treatment of products at the edge of those markets.<\/p>\n

Sawmill residues stay within EUDR<\/strong><\/p>\n

One of the more significant decisions for the primary wood industry concerns HS 4401.<\/p>\n

Fuelwood, wood chips and particles, sawdust and wood waste and scrap remain listed under Annex I. The revised wording now excludes material that legally qualifies as waste under the EU Waste Framework Directive, but this does not amount to a general exemption for sawmill by-products.<\/p>\n

The Commission had received a request to remove wood residues and sawmill by-products under HS 4401 from the EUDR. It declined to do so, noting that these products were already covered by the previous EU Timber Regulation and that the proposed removal lacked support from the relevant industry sectors.<\/p>\n

For sawmills, the distinction is therefore between material that has legally become waste and material that continues to be traded as a commercial product.<\/p>\n

Wood chips supplied to pulp, panel or energy plants and sawdust sold into pellet or board production remain part of the commercial wood chain where they fall within HS 4401. Their origin as a residue from lumber production does not by itself move them outside the EUDR.<\/p>\n

This keeps a substantial share of sawmill output within the traceability system alongside sawn wood.<\/p>\n

<\/a><\/p>\n

New pallets remain covered, circulating pallets do not<\/strong><\/p>\n

The revised Annex I also gives the pallet and packaging sector a clearer dividing line.<\/p>\n

Packing cases, boxes, crates, drums, cable drums, pallets, box pallets and other wooden load boards remain covered under HS 4415 when they are placed on the market as products in their own right.<\/p>\n

A new pallet manufactured and sold as a pallet therefore remains an EUDR product.<\/p>\n

The position changes when packaging is used exclusively to support, protect or carry another product.<\/p>\n

Single-use packaging presented together with the goods it carries is excluded. Packaging designed for repeated use also falls outside the regulation from the point at which it is being used for that purpose. The final text additionally excludes used and second-hand products under HS 4415.<\/p>\n

For the pallet industry, this creates a fairly clear commercial sequence: the new pallet begins as a regulated wood product, but its later circulation as packaging is treated differently.<\/p>\n

That distinction is particularly relevant for pallet pools, logistics operators and companies handling reusable industrial packaging.<\/p>\n

It does not remove the EUDR requirement upstream. Pallet producers still need compliant wood when placing new pallets on the market.<\/p>\n

Second-hand timber products largely taken out<\/strong><\/p>\n

A wider change concerns used timber products. The Commission has inserted second-hand exclusions across much of the wood chapter, including sawn wood, continuously shaped wood, particleboard, OSB, fibreboard, plywood, densified wood, wooden frames, packaging, cooperage products, tools, joinery, kitchenware and other manufactured wood products.<\/p>\n

The same principle extends further downstream. Used goods are no longer treated in the same way as an equivalent newly manufactured product entering the market for the first time.<\/p>\n

For companies active in reclaimed building materials, used furniture, industrial reuse or secondary timber markets, this substantially clarifies where the EUDR chain ends.<\/p>\n

It does not, however, create a general recycled-content exemption for newly manufactured products. A new product containing virgin wood remains subject to the rules applicable to that material.<\/p>\n

<\/a><\/p>\n

Panels and manufactured wood stay in<\/strong><\/p>\n

There is no comparable removal of the major industrial wood categories.<\/p>\n

Particleboard, OSB, fibreboard and plywood remain covered for new products. Builders' joinery and carpentry remain listed, as do wooden tools, kitchenware and numerous other processed products.<\/p>\n

The Commission had also considered requests to remove wooden tools and kitchenware from Annex I, but did not adopt those proposals.<\/p>\n

For timber suppliers, this means the EUDR continues well beyond logs and lumber.<\/p>\n

Wood entering panel mills, joinery plants, furniture production and other industrial processing chains remains linked to the regulation where the final products fall within Annex I.<\/p>\n

Recovered paper gets a firmer exemption<\/strong><\/p>\n

The pulp and paper sector receives one of the clearer changes. Chapter 47 continues to cover wood pulp and Chapter 48 continues to cover paper, paperboard and related products, but the revised wording explicitly removes recovered waste and scrap products and products derived from recovered waste and scrap.<\/p>\n

Used and second-hand products are also excluded. Virgin wood pulp therefore remains within the EUDR, while qualifying recovered material sits outside it.<\/p>\n

For mills using both virgin and recovered inputs, the distinction remains important. The use of recovered paper does not automatically remove a product from the regulation where relevant virgin material is also present.<\/p>\n

The final text also extends packaging exemptions to qualifying paper and paperboard packaging used solely to carry or protect another product.<\/p>\n

Core timber supply chain remains unchanged<\/strong><\/p>\n

The revision is therefore less a reduction of EUDR coverage than a definition of its outer limits.<\/p>\n

Freshly produced roundwood and sawn wood remain covered. So do commercial chips and sawdust, panels, virgin wood pulp, paper containing relevant virgin material, new wooden packaging, joinery and furniture.<\/p>\n

The main exclusions now concern products that have genuinely left their first commercial lifecycle, material legally classified as waste, qualifying recovered paper and packaging already performing its transport function.<\/p>\n

For primary wood processors, Brussels has consequently preserved most of the existing regulatory chain.<\/p>\n

That will be particularly relevant for integrated companies. A sawmill may sell lumber, chips and sawdust into three different markets, yet all three streams can remain within the EUDR if they are commercial products rather than waste.<\/p>\n

December deadline unchanged<\/strong><\/p>\n

Publication of the new Annex I does not change the application calendar.<\/p>\n

The EUDR applies from 30 December 2026 to large and medium-sized operators. The same date applies to micro and small operators dealing in timber products that were already covered by the EU Timber Regulation.<\/p>\n

Other micro and small operators move to the new regime from 30 June 2027.<\/p>\n

The former EU Timber Regulation itself will be repealed when the EUDR enters into application on 30 December 2026.<\/p>","protected":false},"excerpt":{"rendered":"
